Recently, the National Health and Family Planning Commission issued the interim measures for the Administration of the record of traditional Chinese Medicine clinics (decree No. 14 of the National Health and Family Planning Commission, hereinafter referred to as the "interim measures"), pointing out that traditional Chinese medicine clinics are not allowed to provide western and western medicine services. Not all traditional Chinese medicine services can be carried out, and those with uncontrollable medical safety risks and risks to the technology carried out shall not be carried out in traditional Chinese medicine clinics, such as traditional Chinese medicine minimally invasive technology, traditional Chinese medicine injection, acupoint injection and so on.

Article 14 of the "Chinese Medicine Law" stipulates: "The Chinese medicine clinic shall publicize the scope of diagnosis and treatment of the clinic, the name of the Chinese medicine doctor and the scope of practice in the obvious position of the clinic, and shall not carry out medical activities beyond the scope of the record." The Chinese medicine clinic referred to in the "Interim Measures" is a clinic that uses Chinese medicine and non-drug therapies such as acupuncture, cupping, and massage to carry out diagnosis and treatment services under the guidance of Chinese medicine theory, as well as Chinese medicine pharmacy services such as Chinese medicine dispensing and decoction. These Measures are not applicable to those who do not meet the scope of services specified above or have uncontrollable medical safety hazards and risks. First, it is stipulated that traditional Chinese medicine clinics shall not provide western medicine and western medicine services; second, not all traditional Chinese medicine services can be carried out, and those with uncontrollable medical safety risks and risks of the technology carried out shall not be carried out in traditional Chinese medicine clinics, such as minimally invasive technology of traditional Chinese medicine, traditional Chinese medicine injection, acupoint injection, and so on.

 The person in charge of the record Chinese medicine clinic must obtain the qualification of a medical practitioner.

The "Interim Measures" stipulate the conditions that should be met for holding a TCM clinic for the record in terms of the qualifications of personnel, clinic standards, names, environmental protection and fire protection requirements, and the circumstances under which clinics are not allowed to be held.

First, it stipulates the basic requirements of the main person in charge of the clinic. For those who have obtained the qualification of practicing doctors after examination, considering that the national health and Family Planning Commission and the State Administration of traditional Chinese medicine have carried out pilot work to encourage the society to run traditional Chinese medicine in 40 cities and Gansu Province, it has been allowed to adjust the practice period from 5 years to 3 years, combined with the reform spirit of "release, control and service" of the State Council, it is stipulated in the first paragraph of Article 5 of these Measures that "he has a" Physician Qualification Certificate "of the category of Chinese medicine and has been registered to practice in medical, preventive, and health care institutions for 3 years". For those who study traditional Chinese medicine in the form of a teacher or who have years of practice and expertise in medical skills, they shall obtain the Certificate of Qualification of Traditional Chinese Medicine (Specialty) Physician.

Second, it is stipulated that the holding of TCM clinics should conform to the Basic Standards of TCM Clinics.

Third, the name of the TCM clinic should comply with the relevant provisions of the Regulations on the Management of Medical Institutions.

Fourth, the holding of Chinese medicine clinics should comply with the relevant provisions of environmental protection and fire control.

Fifth, the holding of Chinese medicine clinics should be able to bear civil liability independently.

At the same time, it is clear that TCM clinics are not allowed to be held, that is, the situation that medical institutions are not allowed to be set up as stipulated in the detailed rules for the implementation of the regulations on the Administration of Medical institutions.
