The detailed rules for the implementation of the regulations on the management of medical institutions are amended to allow in-service personnel to apply for medical institutions

On February 28, the National Health and Family Planning Commission issued the "Decision on Amending the Implementation Rules of the Regulations on the Management of Medical Institutions" on its website. The "decision" makes it clear that five categories of medical institutions, such as medical laboratory laboratories, will be added, and the content that "medical personnel who are on the job, retired due to illness, or left without pay shall not apply for the establishment of medical institutions" will be deleted.

The "Decision" revised the categories of medical institutions specified in Article 3 of the original "Implementation Rules" and added some new types of institutions, including medical laboratory laboratories, pathological diagnosis centers, medical imaging diagnosis centers, hemodialysis centers, and hospice care. The center, and the original medical institution category "Maternal and Child Health Hospital" was revised to "Maternal and Child Health Hospital, Maternal and Child Health Family Planning Service Center".

The "Decision" deleted the content of the third item of the first paragraph of Article 12 of the original "Implementation Rules" that "medical personnel who are on the job, retired due to illness, or left without pay shall not apply for the establishment of medical institutions. According to the interpretation issued by the National Health and Family Planning Commission at the same time, the revised ''Implementation Rules'' regarding the conditions for medical institutions to set up applicants will focus on medical quality and safety, focus on reviewing the medical conditions and qualifications of applicants, and give full play to the professionalism of doctors Technical advantages, mobilize the enthusiasm of doctors to start their own businesses; promote private investment, accelerate the development of social medical services, and promote the formation of a diversified medical structure.

Article 38 of the original "Implementation Rules" put forward requirements for medical institutions to report and file. The "Decision" amended it to read: "Health and family planning administrative departments at all levels shall use electronic licenses and other information-based methods to implement full-process management and dynamic supervision of medical institutions."

It is interpreted that the implementation of the electronic license system is of great significance to accelerate the transformation of government functions, improve the service efficiency and transparency of health and family planning administrative departments, and further improve the supervision during and after the event.

In addition, Article 18 of the original "Implementation Rules" stipulates that "the architectural design of medical institutions must be reviewed and approved by the establishment approval authority before construction". As the architectural design of medical institutions involves multiple departments, each department should take their own responsibilities, promote parallel approval, and do not set pre-conditions for approval. Therefore, the revised "Implementation Rules" stipulates: "The architectural design of medical institutions must be reviewed and approved by the relevant examination and approval authorities in accordance with the requirements of laws, regulations and rules before construction".
